Flipping Off Cops

This guy is obviously an attention seeking douche, but flipping off cops isn't a crime, so the cop was out of line and should go fuck himself. Too bad when cops are out of line they get paid vacations.

    Doesn't matter if the stop was legit to begin with. Fact is, the cop did stop him. Once he does stop you, you don't refuse to show him your ID. You comply with his orders, then you got a case. You wanna show your ass, enjoy your free room & board for a night. Asshole.

    I've watch a lot of this type of vid and if you have not committed a crime you do not have to identify yourself, its the same in the UK. but just to speed up progress it helps if you do

    We're getting more people trolling us in the fire department too. During the riots, one drunk rioter got beaten the fuck up. We put him on a backboard and had a dozen cameras in our faces, asking for our names and badge numbers, telling us that it was an illegal arrest, nevermind that we're firefighters and he was unconscious and had his front teeth busted out.

    I believe he was taken in just because he didn't provide ID. You have to show ID. Cop would have run his ID, presumably found nothing and then couldn't do anything. The flipping him off thing doesn't even come into it.

    Cop was in the wrong here, he just didn't like being flipped off and then the guy not cooperating was well in his rights not to. Disorderly conduct in most jurisdictions consists of being drunk in public, fighting, disturbing the peace, or loitering. It's very vague and usually cops use it at their discretion as a catch all in order to justify them into being able to search you or your belongings. Most times even if the cop was wrong the burden is on proving that the cop was intentionally trying to cause you harm or malicious prosecution but since a lot of laws are at the officers discretion and are not so clear cut it really is difficult to sue a cop

    @realtalks The cop was wrong for pulling the guy over just because he got flipped off. But once you're at that point, the driver still has to show his driver's license & insurance.

    Another thing is you don't necessarily have to show ID to a cop. Most encounters with cops fall under 3 things, consensual, detain, or arrest. Now a cop can stop and just ask questions to you without any regard, could be friendly or they could be looking for something but they have no reasonable suspicion to detain you. Easiest way to find out what type of stop is to ask if you're free to leave. If you can leave then just leave. If you're being detained then the cops have reasonable suspicion that you have, are in the process of, or are about to commit a crime.

    Many states have stop and identify laws but reasonable suspicion is needed, an ID is not necessarily needed but you can be required to provide your name and possibly some other biographical data to identify you.

    During an arrest you are required to provide your biographical data so that the officer can complete the arrest report, some people want to make this difficult so they end up spending a few days in jail while their fingerprints are being run.

    There's good and bad cops just like there's good and bad people out there, not every cop is out to do you harm or give you trouble, I follow the give me respect and I'll do the same to you but if you wanna be a dick then you have to deal with the consequences.     The cop should have lectured the guy like a little kid and let him go with a warning...tell him if he makes it a habit of flipping off cops, eventually he come across a cop that won't be as nice as him. By arresting him, the cop just made more work for himself.

    You're not required to show identification unless your a Mexican in AZ.. then you have to show them 2 forms of ID, a birth certificate a passport and sacrificial goat.

    Real talks nailed it. Before everyone had a portable recording device, cops could pretty much do or say as they wanted since it would be your word against theirs. But like he said you DON'T have to identify yourself if you don't have a reason to and are not being detained. It's a matter of if you are willing to endure the temporary consequences for not complying with an officers requests. Most people just give it up because they don't know their rights, are afraid of getting arrested, or being roughed up by the cops.

    Cops are not required to 'know the law'. They are schooled in general areas, chapters and units of statutes if you will, but any detail isn't necessary. They ARE however, evidence gatherers. Here is where keeping your mouth shut helps the most. If you choose to ID yourself, fine. But, for shit's sake don't think you can 'just tell my side' and the cop is going to consider it and you'll stroll away. There's a reason for Miranda readings, but the cop is gathering information and evidence THE INSTANT HE OPENS HIS MOUTH TO YOU. Many times what you spill that he needs to continue or have probable cause comes out of your mouth L O N G before you're arrested and advised of your rights. The officer is NOT an expert on the law nor the latest SCOTUS rulings. The roadside is NOT where you argue your rights or any such drivel. Save that for the Court, where it's supposed to be determined.

    I once had the occasion to need a felony lawyer. After it was tossed out and he'd long since collected the $5k upfront, he told me: "If you can do three things, I can almost assuredly get you out of most trouble. 1). Keep your mouth shut. 2). Keep your damn mouth shut. 3). Keep your fucking mouth shut. 60% of what they convict you with either comes directly out of your mouth or your blabbing gives them leads and hints where to look for further evidence or even brand new charges."

    @realtalk, study more bro. You don't even need to be driving. You can be stopped while walking and asked for ID. When asked, you are required to provide it. Probable cause? Seriously? Any cop can pull up a MILLION reasons when needed. It's not a search, it's not an arrest. It's a request for identification and refusing will have your ass in jail until you provide it or fingerprints establish it. There's more than a few jailhouse lawyers sitting in jail telling the jailers about their "rights" as we speak. The dumbass lost this one, and lost it for a reason.

    How modern law works: The cop can stop you or pull you over for whatever reason they want. Even if you have broken no laws, once they tell you to do something and you don't BAM: non-compliance/ hindering an investigation/disorderly conduct. They tell you to step out and you don't, BAM: resisting arrest (felony). You can talk back, complain, cry, get a temper but that will only make them look like they where right in any action they take after.
